The impact of social media has caused various posts focusing on variations or interpretations of popular content to go viral in recent years. Edwar RiaΓ±o, better known as "El Topi," is one of the latest to popularize his content in this way. In Colombia, the phrase "Bing Bang, tiquitiquitang" has become popular in recent months after RiaΓ±o published a vallenato version of the intro to the children's series Lazy Town, amassing more than 600,000 followers on TikTok and more than 300,000 on Instagram.
The content creator's popularity has grown so much that on November 8, 2024, he released the official video of his version of the children's song on his YouTube channel, in which he borrowed several references from the Icelandic show starring MagnΓΊs Scheving. Initially, the song "El Topi" was considered a hit, achieving more than 300,000 views in its first week, but this prompted Turner, the company that owns the rights to LazyTown, to issue a statement announcing that it will sue the Colombian.
The document states that the company aims to "obtain compensation for the material and non-material damages suffered by the cast members of the children's series Lazy Town, as a result of the plagiarism and unauthorized modification of the musical work." Regarding the song released by the Colombian singer, the statement indicates that it has several aspects similar to the intro of the children's program, which represents clear plagiarism by "El Topi" and Viral Street, the single's producer.
"It has similar elements in its rhythm, melodic notes, chords, and time signatures, as well as in the chorus, which allows for a special repetitiveness, recognition, and familiarity. Furthermore, the grammatical constructions and phonetics of the same context as the musical work titled 'Bing Bang' radically violate the plaintiffs' property rights, moral rights, related rights, phonographic rights, and other fundamental rights," the document states.
Legal implications of the lawsuit
In an interview with El Tiempo, attorney Jorge Bedoya, a specialist in media and entertainment law, indicated that the Colombian singer will most likely seek an agreement to receive a "license" that would allow him to perform his version of the children's song. "What the influencer will have to do is negotiate a license, due to the popularity of his version, although I don't think there will be criminal consequences. Within the Colombian system, there are exceptions and limitations to copyright, which could be used by the influencer's defense."
For his part, jurist JosΓ© RodrΓguez Mendoza indicated that the content creator could be protected under certain exceptions, since what "El Topi" created is a parody, not a remake of the single, but that this would not be the case with the music video, in which he used costumes from the series. βIn the case of the song "Bing Bang," it is protected by the AFI of the Republic of Iceland, so its creators must request authorization for its use. "El Topi," by transforming, modifying, or changing the song, commits an unauthorized modification that has judicial repercussions. In the criminal sphere, he could be implicated in the crime contemplated in Article 270 of the Penal Code, specifically in section three,β RodrΓguez told El Tiempo.
The section mentioned by the lawyer indicates that if a citizen violates the moral rights of an author, they could receive a sentence of between 32 and 90 months in prison or a fine of between 26.6 and 300 times the current legal minimum monthly wage.

Besides that this is parody and Turner is not located in Iceland, the 'legal letter' is full of mistakes. Like Lazy Twon (instead of LazyTown) and Magnus Schevin (instead of MagnΓΊs Scheving).
